The e-Scholar Student Laptop Computer Agreement

I hereby acknowledge acceptance of the laptop computer agreement from University of Wisconsin-Stout (hereinafter referred to as "the University") to govern the use of a university provided laptop while I continue to be enrolled at the University, for three or more credits, based on the following details and terms:
1. The laptop computer, which is provided for my use with no transfer of ownership, will be either a fully configured Hewlett-Packard or Apple laptop computer, including a battery(s), cords, carrying case and other appropriate
accessories (hereinafter referred to as "the computer"). The brand of computer provided will be determined by the University based on my major. I will retain possession of the computer until I am no longer enrolled at the
University or the University's lease on my particular computer expires (at which time it will be replaced by another computer).
2. I will not remove or alter any University or other identification labels attached to or displayed on the computer.
3. I will not assign, transfer, pledge or otherwise dispose of this Agreement or any interest herein, or lend the computer or otherwise permit it to be possessed or used by anyone other than me.
4. I agree to adhere to the University's regulations and policies governing the use of the computer. I agree to comply with all applicable State and Federal law including copyright and intellectual property law pertaining to software.
5. The computer is and will, at all times, remain the property of HP Financial Services or the University. I will have no title or other ownership interest in the computer.
6. I agree to use the computer in a careful and lawful manner, and will not make any alterations, additions or improvements to the computer without prior written consent of the University. Such alterations include but are not
limited to adding memory or input/output devices. Should additions and/or improvements be made to the computer such improvements will belong to the University. The University may, at its discretion, remove any additions to
and/or alterations of hardware or software.
7. I am responsible for the full replacement cost of any computer hardware rendered unusable by a user-applied electronic security method. These methods include, but are not limited to, application of passwords, biometric
identification or security software.
8. I am responsible for maintenance of software applications and hardware not provided by the University.
9. Upon request, I agree to deliver the computer to the University's ASK 5000 Help Desk for inspection or to verify
inventory/asset information. Failure to comply by the date requested may result in a hold being placed upon my course registration privileges and transcript or other appropriate actions or sanctions.
10. I agree to take reasonable and prudent care to keep the computer secure and safe. I will bear the risk of loss by theft, destruction, or damage of the computer until it is returned to the University. If the computer is found to be damaged during inspection by a University authorized repair technician, the University may charge me a $50 fee for the first
incident of damage and incrementally escalating $50 fee for each subsequent incident of damage. (Fifty for the first incident, $100 for second incident, $150 for third incident etc.) These amounts will be added to my University
account.
11. I am responsible for the full replacement cost for any lost, damaged or missing accessory. No exception will be made for late return of accessories. Accessory charges will be added to my University account.

12. I must report theft (or suspected theft) or other loss of the computer within 48 hours to the University's ASK 5000 Help Desk and to the police department in the jurisdiction in which the theft or loss is believed to have occurred (UW-Stout Police 715-232-2222, Menomonie Police Dept. 715-232-1283). The university may bill me for the replacement cost of the laptop and accessories if I fail to report theft or loss or suspected theft or loss within 48 hours. To receive a replacement computer, I will submit a written copy of the police report to the ASK5000 Help Desk. In cases of theft or loss, I may be responsible for a $400 fee. These amounts will be added to my University account.
13. Upon my graduation, withdrawal or dismissal from the University, upon notification of the expiration of the University's lease on my particular computer, or upon any other notification to turn in the computer, I agree to deliver the computer to the University's ASK 5000 Help Desk or such other place designated by the University. In the event that I do not return the computer within stated timeframes, the University may, at its discretion, place a hold on my university record, bill me for the replacement cost of the computer and/or a $400 fee, or file a loss claim with the University's insurance company which would initiate repossession or police investigative action.
14. I agree that the University may amend the terms of this agreement (to include cancellation) upon serving me a written Notice of Amendment. Any such notice will be served by U.S. Mail and addressed to me at my local address, or delivered in person by University personnel. Such Notice of Amendment will be effective 10 days from the date of the mailing or delivery.
15. Apple Computer, Inc., Hewlett-Packard Company, HP Financial Services, and the University are not responsible for any injuries, damages, penalties, or losses, including legal costs and expenses, incurred by me or any other person caused by the transportation, installation, use of or any other matters relating to the computer.
16. This agreement and any amendments or supplements to it will be governed by the laws of the State of Wisconsin.
17. No delay or failure to enforce any provision of this Agreement will constitute a waiver or limitation of the University's rights of enforcement under it.
